1. Introduction and Acceptance
Welcome to NeuroPathway Safe Space ("Platform", "Service", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the NeuroPathway platform, including our websites, applications, and services available at neuropathwaysafespace.org.
By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
These Terms apply to all users including: young people (ages 8-17), parents/carers, healthcare professionals, educational staff, social care workers, and organizational administrators.
2. Service Description
NeuroPathway Safe Space is a digital health platform designed to:
- Support neurodevelopmental assessment and EHCP evidence collection
- Provide youth mental wellbeing monitoring through the Safe Space app
- Enable multi-agency collaboration between schools, NHS, and social care
- Offer educational resources and professional training on neurodiversity
- Generate AI-assisted reports and evidence documentation
Important: The Platform is a support tool, not a replacement for professional medical advice, diagnosis, or treatment. Always seek the advice of qualified healthcare providers with questions about medical conditions.
3. User Accounts and Registration
3.1 Account Creation
To access certain features, you must register for an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain and update your information to keep it accurate
- Keep your login credentials confidential and secure
- Notify us immediately of any unauthorized account access
- Accept responsibility for all activities under your account
3.2 Professional Verification
Healthcare, education, and social care professionals must verify their credentials. We reserve the right to request proof of professional registration (GMC, NMC, HCPC, DfE, Social Work England) before granting professional-level access.
3.3 Young People's Accounts
The Safe Space app is designed for young people aged 8-17. Parents/carers should be aware of their child's use of the platform. Young people retain control over data sharing preferences in accordance with their capacity and Gillick competence principles.
4. Acceptable Use Policy
4.1 Permitted Uses
- Personal wellbeing monitoring and self-reflection
- Clinical assessment support and evidence gathering
- Professional collaboration and case management
- Educational resource access and training completion
- Parent/carer support and family coordination
4.2 Prohibited Uses
You agree NOT to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Impersonate any person or entity, or falsely state your affiliation
- Access accounts or data belonging to other users without authorization
- Attempt to bypass security measures or gain unauthorized access
- Upload malicious code, viruses, or harmful content
- Harass, abuse, or harm other users
- Use automated systems to access the Service without permission
- Reverse engineer, decompile, or extract source code from the Platform
- Copy, redistribute, or commercially exploit Platform content
- Use the Service to build competing products or services
5. Safeguarding and Child Protection
We take safeguarding extremely seriously. The Platform includes:
- AI Monitoring: Automated detection of concerning content (self-harm, abuse indicators)
- Alert Systems: Notifications to designated safeguarding leads when risks are identified
- Crisis Resources: Immediate access to helpline information (Childline, Samaritans, 999)
- Professional Oversight: Qualified safeguarding team review of flagged content
By using the Platform, you acknowledge that:
- Safeguarding concerns may override confidentiality to protect children
- Designated adults may receive alerts about concerning content
- We may be legally required to report concerns to authorities
- Professional users must follow their organization's safeguarding procedures
6. Data Protection and Privacy
Your privacy is important to us. Our use of your personal data is governed by our Privacy Policy, which forms part of these Terms.

7. Intellectual Property Rights
The Platform and its original content, features, and functionality are owned by NeuroPathway Safe Space and are protected by international copyright, trademark, and other intellectual property laws.
7.1 Our Content
All Platform content including text, graphics, logos, images, audio, video, software, and the compilation thereof is our property or licensed to us. You may not reproduce, distribute, or create derivative works without written permission.
7.2 Your Content
You retain ownership of content you create (journal entries, assessments, uploads). By submitting content, you grant us a limited license to store, process, and display it for Platform functionality. We will never sell or commercially exploit your personal content.
8. Subscriptions and Payment
8.1 Free Services
The Safe Space app is FREE for all children and young people whose school holds a NeuroPathway licence. Basic educational resources are available at no cost.
8.2 Paid Subscriptions
Organizations (schools, NHS trusts, local authorities) may subscribe to professional features. Subscription terms include:
- Fees are billed annually unless otherwise agreed
- Prices may be adjusted with 30 days notice for renewals
- Refunds are available within 14 days for new subscriptions
- Cancellation takes effect at the end of the billing period
8.3 Add-On Modules
Specialist modules (Housing Support, Probation Services) are available as additional extras with separate pricing. Contact us for enterprise and custom licensing options.
9. Service Availability
We strive to maintain 99.9% uptime but cannot guarantee uninterrupted service. We may:
- Perform scheduled maintenance with advance notice where possible
- Make emergency updates to address security vulnerabilities
- Temporarily suspend service for technical issues
- Modify or discontinue features with reasonable notice
Emergency Services: The Platform is NOT an emergency service. In crisis situations, contact 999 (emergency), Childline (0800 1111), or Samaritans (116 123).
10. Disclaimers and Limitations
10.1 Medical Disclaimer
The Platform provides support tools and educational content. It does NOT provide medical diagnoses, clinical treatment recommendations, or emergency intervention. Always consult qualified healthcare professionals for medical decisions.
10.2 AI-Generated Content
AI features (emotional support, EHCP suggestions, risk assessments) are supplementary tools. Professional judgment must always be applied. AI-generated content may not be accurate in all circumstances.
10.3 Limitation of Liability
To the maximum extent permitted by law, NeuroPathway Safe Space shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Decisions made based on Platform content or AI recommendations
- Third-party actions or content
- Service interruptions or technical failures
11. Termination
11.1 By You
You may terminate your account at any time by contacting us or using account settings. Upon termination, you may request data export in accordance with our data portability obligations.
11.2 By Us
We may suspend or terminate your access if you:
- Violate these Terms or our policies
- Engage in fraudulent or illegal activity
- Pose a risk to other users or platform security
- Fail to pay applicable fees (for paid accounts)
11.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Certain provisions survive termination including intellectual property rights, disclaimers, and limitation of liability. Clinical records may be retained as required by NHS records management standards.
12. Dispute Resolution
We aim to resolve disputes informally. If you have a concern:

13. Changes to Terms
We may modify these Terms at any time. When we make material changes:
- We will update the "Last updated" date
- We will notify registered users via email
- We will post a notice on the Platform
- Continued use after changes constitutes acceptance
If you disagree with updated Terms, you should discontinue use and request account deletion.
